Terms & Conditions
Effective Date: October 2025
Welcome to Sonoran Containers (“we,” “our,” or “us”). By using our website, placing an order, or engaging our services, you agree to the following terms and conditions. Please read them carefully before purchasing, renting, or requesting modifications.
1. Products & Services
We sell and rent brand-new one-trip shipping containers, container kits, add-ons, and modification services.
All descriptions, pricing, and availability are subject to change without notice.
Product photos are for illustrative purposes — actual colors, finishes, or dimensions may vary slightly due to manufacturing or customization.
Videos and photos of the actual container, including the container’s serial number, will be provided prior to purchase whenever possible.
2. Orders & Payments
Full payment is required prior to delivery or modification unless otherwise approved in writing.
Accepted payment methods include credit card, ACH transfer, or approved business check.
-
Funds from business checks or ACH transfers must clear before delivery or pickup is scheduled.
-
By paying via credit card, you waive any right to file a chargeback. Disputes will be handled directly with Sonoran Containers.
-
All sales are final due to the nature of large steel freight, custom work, and transportation costs.
Quotes are valid for 10 days unless otherwise specified.
3. Shipping & Delivery
We offer delivery throughout Arizona and regional shipping to California, Nevada, Utah, Colorado, and New Mexico.
Free delivery applies within Pima and Pinal Counties.
Delivery timelines are estimates and may vary based on weather, access, or freight carrier availability.
Customers are responsible for ensuring the delivery site is:
-
Level, compacted, and accessible for a 40-foot truck and trailer.
-
Clear of obstructions, power lines, low branches, and soft ground.
-
Has at least 120 feet of straight, drivable clearance in the direction of delivery for safe truck exit.
If the driver cannot safely access or complete delivery due to site conditions, a failed delivery fee will apply, and the container will be returned to the yard.
If a redelivery is requested after the site is prepared, an additional delivery fee will apply.
Containers equipped with rear-mounted HVAC units (such as mini-splits) will be loaded and transported with doors facing forward for safety and clearance.
4. Returns & Refunds
All container sales, rentals, and modifications are final unless the unit arrives damaged in transit or defective due to workmanship.
Any claim must be submitted within 48 hours of delivery with supporting photos or video.
Refunds or replacements are issued solely at our discretion once the claim is verified.
5. RENTAL TERMS — SONORAN CONTAINERS
General Conditions
Rental containers must remain at the approved delivery location unless moved by Sonoran Containers.
The renter may not relocate, sublease, or modify the container without written approval. Any unauthorized relocation or modification voids this agreement and constitutes default.
Renters are responsible for maintaining the container in reasonable condition and ensuring safe, clear access for pickup, inspection, or repossession at all times.
Rental fees are due monthly in advance. Failure to pay rent on time may result in late charges, suspension of services, repossession, or removal of the container.
Payment & Late Fees
Rent is due in full on or before the date stated on your invoice or agreement.
If rent is not received by the sixth (6th) day after the due date, a $5 per-day late fee will be assessed until the balance is paid in full, consistent with Arizona law (A.R.S. § 33-1703).
Returned checks or failed payments will incur a $35 returned-payment fee.
All business checks and wire transfers must clear prior to delivery or pickup.
Failure to maintain current payment status may result in repossession without further notice once legal notice requirements have been met.
Default & Right to Repossess
If rent or other charges remain unpaid after the due date, or if any term of this agreement is breached, Sonoran Containers may declare the renter in default and retake possession of the rented container and any installed equipment.
Renter expressly consents to reasonable access by Sonoran Containers or its authorized agents to the delivery site for the purpose of inspection, pickup, or repossession, subject to applicable law.
Sonoran Containers will provide written notice of default and a minimum ten-day cure period before repossession or sale, unless immediate action is required by law or for safety.
Repossession will be conducted peacefully, in a commercially reasonable manner, and in compliance with Arizona law.
If required for safety or compliance, Sonoran Containers may request assistance from law enforcement to carry out repossession.
Access Rights & Entry Authorization
Renter grants Sonoran Containers, its employees, or contractors the unrestricted right to access the delivery property for inspection, servicing, or repossession of equipment.
This access right includes permission to enter private driveways, gates, or yards necessary to safely retrieve the container.
Sonoran Containers is not responsible for damage to lawns, driveways, or terrain resulting from reasonable efforts to access or remove the container.
Handling of Contents, Liens & Sale
Any items left in a repossessed container are considered abandoned property and are subject to a possessory lien under Arizona law (A.R.S. § 33-1704).
After repossession, Sonoran Containers may remove, store, repair, or sell the container and its contents at public or private sale to recover unpaid rent, fees, and costs.
Proceeds from any sale will be applied in the following order:
-
Repossession, towing, storage, repair, attorney’s fees, and sale costs.
-
Outstanding rent, late fees, and other unpaid charges.
-
Any remaining surplus will be returned to the renter.
Renter remains liable for any deficiency if sale proceeds do not cover the full balance.
By signing this agreement, renter waives any claim for damages or loss arising from lawful repossession, removal, or sale performed under these terms. -
Site Access & Delivery Conditions
To ensure safe delivery and removal, the renter must provide a site that meets all access and grade requirements:
-
A minimum of 120 feet of straight-line clearance from drop point for truck, container, and trailer exit.
-
A level, compacted surface, free of mud, ruts, soft ground, or overhead obstructions.
-
Adequate turning radius and clearance for a full-size truck and gooseneck trailer.
If the driver cannot safely deliver or remove the container due to site conditions or obstructions, a failed-delivery or retrieval fee will apply, and the container will be returned to our yard.
If the site is later corrected and redelivery is requested, a new delivery charge will apply.
All containers with rear-mounted HVAC or mini-split systems will be loaded and transported with doors facing forward to protect cooling equipment during transit.
Storage, Abandonment & Auction Timeline
Following repossession or abandonment, Sonoran Containers may store the container and its contents at its facility and charge $10 per day for storage until sale or removal.
A sale or disposal may occur no sooner than fifteen (15) days after written notice has been sent to the renter, consistent with Arizona Revised Statutes.
If sale proceeds are insufficient to satisfy outstanding balances, renter remains responsible for the difference.
Insurance & Liability
Renter assumes all risk of loss or damage to the container from any cause other than normal wear and tear.
Sonoran Containers recommends maintaining renter’s insurance or commercial liability coverage sufficient to cover loss, theft, fire, vandalism, or damage caused by equipment misuse.
Sonoran Containers shall not be liable for indirect, incidental, or consequential damages arising from rental, transport, or repossession.
Termination
Either party may terminate this rental agreement upon written notice once the rental term ends and all fees are paid.
If renter fails to vacate or allow pickup upon termination, Sonoran Containers may treat the container as abandoned and proceed under the repossession and sale provisions above.
Customer Acknowledgement
By renting from Sonoran Containers, the renter acknowledges, understands, and agrees to all terms stated herein, including:
-
Payment and late-fee obligations.
-
Access, delivery, and repossession requirements.
-
Sale and lien rights under Arizona law.
